Uniform Acknowledgment Act

On July 8, 1997 the "Uniform Acknowledgment Act" was signed into law (Chapter 179 of the Laws of 1997). The purpose of the act was to establish a form that can be used when taking the acknowledgment of any person or entity. The act provided for a phase-in period from July 2, 1997 through August 31, 1999, during which time, use of the authorized from acknowledgment was permitted, but not required.

BEGINNING SEPTEMBER 1, 1999 the uniform form of Acknowledgment MUST be used for ALL acknowledgments when both of the following occur:

  1. The property is located in New York State, and
  2. The acknowledgment is taken within New York State.

The statute provides no guidance as to what form may be used when these criteria are not met.
