Discharge Certificate For Sewer Connections Now Required in Mamaroneck

The Village of Mamaroneck has enacted Local Law No. 09-2007 to prevent illegal sewer connections to public storm water or sanitary sewer lines.ææ This law created a procedure whereby a certificate is issued by the Director or Code Enforcer Officer of Mamaroneck, certifying that all connections leading from a parcel of land to public sewer or sanitary systems comply with the laws regulating this. As of July 1, 2007, all sales of real property (considered a renewal event) will require that a Discharge Compliance Certificate be filed with the Village. For all apartment buildings, cooperatives and condominium complexes this certificate is required for each building on or before August 1, 2007 and it must be renewed every 5 years.æ It is not required each time there is a transfer of tile of one of the units within the apartment building, cooperative or condominium complexes.

In connection with the sale of real property located in the Village, all property owners are now required to contract a plumber licensed to do business within Westchester County to inspect the premises to determine if any of the connections leading the property to the public storm water sewer lines or the public sanitary sewer lines violate the NY State Building Code or the Westchester County Sewer Act, the Westchester County Sanitary Code or the Village Code. The plumber then issues a PlumberÍs Certification that is filed with a fee with the Director or Code Enforcement Officer of the Village of Mamaroneck. The Director then issues a Discharge Compliance Certificate.æ By filing this Certificate, the owner of the property authorizes the Director or his/her designee to enter upon the property for the purpose of conducting an inspection. This discharge certificate can be issued at any time after a renewal event has occurred but shall expire in 60 days after it is issued unless the renewal event occurs before its expiration date. A discharge compliance certificate issued after a renewal event has occurred expires when the next renewal event with respect to that property occurs.æ Thus, it is necessary to obtain this certificate every time title to property is transferred in the Village.

The Director may revoke the Certificate of Completion where there has been any false statement made or mistake of fact made in the application or where the Certificate was issued in error or where it is determined that the owner of the real property causes or allows the use of practice on the property which, if discovered prior to the issuance of the Certificate, would have prevented the Director from issuing the discharge compliance certificate.ææææ
